The EIN, without an SSN.

Every U.S. LLC needs a federal Employer Identification Number to bank, process payments, and file. Here is how non-residents obtain one — properly.

What an EIN is

The Employer Identification Number is your company's federal tax ID — a nine-digit number issued by the IRS. Despite the name, you need one even with no employees: banks, Stripe, PayPal, Amazon, and the IRS itself all identify your LLC by its EIN.

The non-resident path: Form SS-4

The IRS online application is only available to applicants with an SSN or ITIN. Non-residents instead file Form SS-4 by fax or mail:

  1. Complete SS-4 with your LLC's legal name, formation state, and responsible party. On line 7b, where an SSN is requested, write "Foreign."
  2. Fax the form to the IRS international unit (fax is dramatically faster than mail).
  3. Receive your EIN confirmation letter (CP 575) — typically 2–4 weeks by fax, 6–8+ weeks by mail.

Common mistakes

  • Applying before the LLC exists — the entity's legal name and formation date must match state records.
  • Wrong entity classification — line 9a errors create tax-classification headaches that outlast the application.
  • Losing the CP 575 — the original confirmation letter is issued once; banks often insist on it. Store it carefully.
  • Paying for \"instant\" EINs — services claiming same-day EINs for non-residents are either using someone else's SSN improperly or simply lying about timelines.

Can I get an EIN without an SSN or ITIN?

Yes. A non-resident owner applies with Form SS-4, writing "Foreign" on line 7b instead of an SSN. The online IRS application requires an SSN/ITIN, so non-residents must file by fax or mail — or have a service like Westmark handle it.

How long does it take?

Fax applications are typically processed in 2–4 weeks; mail can take 6–8 weeks or more. There is no legitimate way to get an instant EIN without an SSN — be wary of anyone promising one.

Does an EIN mean I owe U.S. taxes?

No. An EIN is an identification number, not a tax status. Whether you owe U.S. tax depends on your activities, entity structure, and treaty position — consult a qualified tax professional.

Do I need an EIN to open a U.S. bank account?

Yes. Banks and fintechs (Mercury, Relay, Wise) require the EIN confirmation letter (CP 575) or at minimum the EIN itself before onboarding your LLC.

Can someone apply on my behalf?
